Please read these Terms of Service ("Terms") carefully before using the Brain Break Kids mobile application (the "App") operated by Brain Break Kids ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms.
Brain Break Kids is designed for children under the age of 13. The App is intended to be used by children only under the direct supervision or with the prior consent of a parent or legal guardian. By allowing your child to use the App, you confirm that you are the parent or legal guardian and that you accept these Terms on behalf of your child. If you do not agree, please do not allow your child to use the App.
We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, solely for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code.
Brain Break Kids does not currently offer in-app purchases. The App is provided free of charge. We reserve the right to introduce optional paid features in the future; any such features will be clearly labelled and require parental authorisation through the device's parental controls or app store account.
You agree not to use the App to:
All content within the App — including but not limited to graphics, animations, characters, text, audio, and software — is the exclusive property of Brain Break Kids or its licensors and is protected by applicable intellectual property laws. The adorable mascots and game characters are original works owned by us. Nothing in these Terms transfers any intellectual property rights to you.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
To the maximum extent permitted by applicable law, Brain Break Kids shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid for the App in the twelve months preceding the claim.
The App may use third-party analytics or crash-reporting services to improve reliability. These services are selected for their commitment to child privacy and are bound by data processing agreements with us. We do not integrate third-party advertising networks.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, where required by law, by more prominent notice. Continued use of the App after changes constitutes acceptance of the updated Terms.
